1. Introduction
Welcome to Berancia, an interface and associated services (collectively the "Interface") provided by Perfect Solution Group, Ltd and its affiliates ("Berancia," "we," "our," or "us").
The Interface provides access to a decentralized protocol on the blockchain that allows users to optimize liquidity provision rewards through automated vault strategies focusing on BGT reward maximization (the "Protocol").
These Berancia User Terms of Service ("Agreement" or "Terms") constitute an agreement between Berancia and you ("you," "your," or "user(s)"), the user of the Interface.
If you are entering into this Agreement on behalf of a legal entity or organization, you represent and warrant that you have the authority to bind such entity to this Agreement.
Arbitration Notice: Please be aware that these Terms contain an arbitration clause. Except for certain types of disputes, you and we agree that any disputes relating to the Interface will be resolved by mandatory binding arbitration, and you waive any right to a trial by jury or to participate in a class action lawsuit or class-wide arbitration.
By accessing or using the Interface, you signify that you have read, understood, and agreed to be bound by this Agreement. If you do not agree to these Terms, you are not authorized to use the Interface.
Restrictions Notice: The Interface is not offered to US Persons or persons in Restricted Territories.
2. Use and Eligibility
As a condition of accessing or using the Interface, you represent, warrant, and covenant that:
You are not a US Person or located in a Restricted Territory.
You are not subject to sanctions or on any sanctions list.
You are using only legally obtained digital assets.
You will maintain security over your private keys and passwords.
Your use of the Interface complies with all applicable laws.
You understand the inherent risks of blockchain technology, smart contracts, and digital assets.
3. Age
You represent and warrant that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into this Agreement.
4. Privacy
We care about your privacy. Berancia only collects:
Your blockchain wallet address
Transaction hashes
Asset identifiers
We do not collect your name, email address, or other personal identifiers.
We use third-party providers such as Alchemy, Infura, Coingecko, The Graph, WalletConnect, and Fathom Analytics. You should review their privacy policies separately.

5. Prohibited Activity
You may not use the Interface to:
Violate anti-money laundering laws or sanctions
Infringe on intellectual property rights
Interfere with security or network operations
Commit fraud or misrepresentation
Violate any applicable law
Harass, stalk, or harm others
6. Access
We may grant you access to the Interface, which is fully revocable at our discretion. Access may be terminated or restricted if you breach these Terms or if your actions threaten Berancia, the Interface, or third parties.
7. Digital Wallet
To access the Protocol, you must connect a self-custodied digital wallet. You are solely responsible for securing your wallet and for all transactions conducted through it. Berancia has no access to your private keys and assumes no liability for your wallet use.
8. No Professional Advice or Fiduciary Duties
All information provided by the Interface is for informational purposes only. We are not your broker, advisor, or fiduciary. We make no representations or warranties about the accuracy, completeness, or appropriateness of any information shared.
9. Interface
Your use of the Interface is at your sole risk. We provide no guarantees about the performance, uptime, or accuracy of any information or services provided. You are solely responsible for verifying all information before relying on it.
10. Protocol
The Protocol is decentralized, experimental, and in active development. It may contain bugs, experience delays, or cause the loss of digital assets. By using the Interface and the Protocol, you acknowledge and accept these risks.
11. Blockchain Technology
Blockchain technology is outside our control. Changes to blockchain protocols (e.g., forks, rollbacks) could materially affect the Interface, the Protocol, and your assets. You assume all risks related to blockchain changes.
12. Fees and Costs
Using the Interface may involve fees, including performance fees and third-party gas fees. You are solely responsible for paying all fees.
13. Gas
You must maintain sufficient digital assets in your wallet to cover gas fees. We are not responsible for incomplete transactions due to insufficient gas.
14. Reversals
Transactions through the Interface are irreversible. We cannot recover assets sent through incorrect or unintended transactions.
15. Interface Availability and Modification
We do not guarantee Interface uptime. We reserve the right to modify, suspend, or discontinue the Interface at any time without notice.
16. Third Parties
We are not responsible for the actions or content of third parties that you interact with through the Interface.
17. Third Party Content
Third-party information available through the Interface is provided "as is." We do not endorse or guarantee the accuracy or reliability of third-party content.
18. Termination
We may terminate your access to the Interface at our discretion if you breach these Terms or applicable laws.
19. Taxes
You are solely responsible for any taxes that apply to your activities on the Interface.
20. Fraudulent Transactions
We reserve the right to investigate and take action against fraudulent activities, including reporting to law enforcement.
21. Intellectual Property
"Berancia," its logo, and all related marks are owned by or licensed to Berancia. You may not copy, distribute, or use our intellectual property without permission.
22. Assumption of Risk
Using blockchain technology and transacting in digital assets involves significant risks, including loss of assets, technological failures, hacking, and changes in regulatory status. You acknowledge and accept all such risks.
23. Limitation of Liability
We are not liable for indirect, incidental, special, punitive, or consequential damages. Our maximum liability, where applicable, is $100 USD or the amount of fees you paid to us in the past six months, whichever is greater.
24. Release
You release Berancia from any claims, damages, or liabilities arising from your use of the Interface or the Protocol.
25. Indemnity
You agree to indemnify and hold harmless Berancia and its affiliates against any claims arising from your use of the Interface, breach of these Terms, or violation of applicable law.
26. No Warranties
The Interface and Protocol are provided "as is," "as available," and "with all faults." We disclaim all warranties, express or implied.
27. Arbitration Agreement and Waiver of Rights, Including Class Actions
All disputes will be resolved by binding arbitration under the International Centre for Dispute Resolution rules, seated in Seychelles. You waive your right to a jury trial and to participate in class action lawsuits.
28. Force Majeure
We are not responsible for failures or delays resulting from events beyond our control, including acts of God, natural disasters, wars, and technological outages.
29. Severability
If any part of these Terms is deemed unenforceable, the remaining parts remain in full force.
30. Non-Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our rights.
31. Survival
All sections that by their nature should survive termination shall survive termination, including Intellectual Property, Limitation of Liability, and Indemnity.
32. Assignment
You may not assign your rights under this Agreement without our prior written consent. We may freely assign our rights.
33. Amendments
We may amend these Terms at any time by posting updated Terms on the Interface. Your continued use of the Interface constitutes acceptance of the amended Terms.
34. Electronic Communications
By using the Interface, you consent to receive communications from us electronically. All communications satisfy any legal requirement that communications be in writing.
